Welcome to Novellessa. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services.

Throughout these Terms, “Novellessa,” “we,” “us,” and “our” refer to the operator of the Novellessa online store. “You” and “your” refer to any visitor, customer, or person using our website.

By accessing our website or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the website or place an order.

1. Online Store Use

You may use this website only for lawful personal shopping purposes.

You agree not to:

• Use the website for fraudulent, unlawful, or abusive activity.

• Attempt to interfere with the security or operation of the website.

• Introduce viruses, malicious code, automated scraping tools, or similar technology.

• Use false information or another person’s identity when placing an order.

• Copy, reproduce, sell, or exploit any part of the website without permission.

• Attempt to gain unauthorized access to customer accounts, systems, or data.

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

2. Customer Information

You are responsible for providing complete and accurate information when placing an order, including:

• Email address.

• Shipping address.

• Billing information.

• Any other details required to process and deliver the order.

You are responsible for reviewing your information before completing checkout.

Novellessa is not responsible for delays, failed deliveries, additional shipping charges, or losses caused by an incorrect, incomplete, or outdated address provided by the customer.

3. Products and Product Selection

Novellessa does not manufacture the products offered in our store.

We work with independent suppliers and fulfillment partners and select products based on their expected balance of quality, usefulness, and value.

Our fulfillment partners may manufacture, store, package, or ship products directly to customers. Novellessa remains responsible for the shopping experience and for assisting customers with eligible order issues under our published policies.

4. Product Information

We make reasonable efforts to present product descriptions, specifications, dimensions, images, colors, features, and included accessories accurately.

However:

• Product colors may appear slightly different depending on screen settings and lighting.

• Measurements may contain minor manufacturing or manual-measurement variations.

• Packaging may be updated by the supplier.

• Minor non-functional design details may change without materially changing the product.

• Images used for presentation might include props or surrounding items that are not included with the product.

The items included with each purchase are described on the applicable product page.

Nothing on the website should be interpreted as medical advice or as a guarantee that a product will prevent, diagnose, treat, or cure a medical condition.

5. Availability and Inventory

Products are offered subject to availability.

Inventory quantities may be managed or updated by independent fulfillment partners and can change without notice.

We reserve the right to:

• Limit the quantity available to one customer, household, payment method, or address.

• Discontinue a product.

• Decline or cancel an order that cannot be fulfilled.

• Correct inventory errors or product information.

If an ordered product becomes unavailable after payment, we will contact you and offer an appropriate resolution, which may include cancellation and a refund for the unavailable item.

6. Prices and Payment

Prices are displayed in the currency shown at checkout.

We may change product prices at any time before an order is placed. A price change does not affect an order that has already been accepted, except where there is an obvious pricing or technical error.

You agree to provide valid and authorized payment information.

Payments are processed through Shopify and available third-party payment providers. Novellessa does not receive or store complete payment-card numbers.

Applicable taxes, customs duties, import charges, remote-area surcharges, or other legally required charges may apply depending on the order, destination, payment method, and shipping circumstances.

7. Pricing and Listing Errors

We may correct typographical errors, inaccurate descriptions, incorrect prices, promotional errors, or other obvious mistakes.

If an error affects an order you have already placed, we may contact you to:

• Confirm the corrected information.

• Offer an alternative.

• Cancel the affected item or order and issue an applicable refund.

We will not intentionally use misleading prices, inventory notices, or promotions.

8. Order Acceptance

Receiving an order confirmation does not always mean that an order has been finally accepted or dispatched.

We may review, decline, limit, or cancel an order when reasonably necessary, including when:

• Payment cannot be authorized.

• Information appears incomplete or inaccurate.

• Fraud or unauthorized payment is suspected.

• Inventory is unavailable.

• The destination is unsupported.

• The order violates these Terms or another published policy.

• A material pricing or listing error occurred.

• The fulfillment partner cannot process the order.

If we cancel a paid order, we will issue an applicable refund to the original payment method.

9. Order Cancellation and Address Changes

Cancellation and address-change requests should be submitted within 2 hours of placing the order.

We will make a reasonable effort to accommodate a request, but changes or cancellations cannot be guaranteed after fulfillment has begun.

Orders generally cannot be changed or canceled after dispatch.

10. Fulfillment and Shipping

Orders are generally processed within 1–3 business days. Weekends and public holidays are not considered business days.

Estimated delivery times are provided in our Shipping Policy and on applicable product pages. Delivery estimates are not guaranteed arrival dates.

Delivery may be affected by circumstances outside our reasonable control, including:

• Carrier delays.

• Customs processing.

• Weather.

• Seasonal demand.

• Remote destinations.

• Transportation disruptions.

• Incorrect or incomplete addresses.

We currently ship only to eligible United States addresses supported by our fulfillment partners.

We do not currently ship to APO, FPO, DPO, or other military addresses.

Availability for Alaska, Hawaii, Puerto Rico, United States territories, and remote locations may vary by product, carrier, and address.

11. Separate Packages

Products in the same order may be supplied or fulfilled by different independent partners.

As a result:

• Items may arrive in separate packages.

• Packages may arrive on different dates.

• Each package may have a separate tracking number.

• One item arriving before another does not necessarily mean that the remaining item is missing.

12. Tracking and Delivery

Tracking information will be provided when available.

A tracking number may require additional time after dispatch before the carrier displays its first update.

Customers are responsible for monitoring tracking information and ensuring that someone can receive the package when necessary.

If tracking shows that an order was delivered but you cannot locate it, you may be asked to:

• Check with household members or neighbors.

• Check safe delivery locations around the address.

• Contact the carrier or local postal office.

• Obtain written confirmation from the carrier when reasonably available.

Lost-package claims are reviewed according to our Shipping Policy.

13. Customs and Additional Delivery Charges

Standard shipping is free on eligible United States orders.

When applicable, the customer is responsible for:

• Customs duties.

• Import taxes.

• Remote-area surcharges.

• Address-correction fees.

• Re-delivery charges.

• Charges caused by customer-requested changes after ordering.

These charges are not imposed in every case and depend on the destination, carrier, and circumstances of the shipment.

14. Returns, Replacements, and Refunds

Eligible damaged, incorrect, incomplete, or defective products are handled according to our Return and Refund Policy.

Customers must contact Novellessa within the applicable reporting period and provide the evidence reasonably required to review the claim.

Do not return a product before receiving return authorization and instructions from Novellessa.

Our Return and Refund Policy forms part of these Terms.

15. Third-Party Suppliers and Fulfillment Partners

We rely on independent third parties for services such as:

• Manufacturing.

• Warehousing.

• Inventory management.

• Order fulfillment.

• Shipping.

• Tracking.

• Payment processing.

These partners are independent businesses and are not employees or agents of Novellessa.

We may share the order information reasonably required for payment, fulfillment, delivery, fraud prevention, and customer support.

The use of third-party partners does not remove the customer’s obligation to contact Novellessa first regarding an order placed through our store.

16. Third-Party Services and Links

The website may include links, features, payment methods, applications, or services provided by third parties.

We do not control every third-party website or service and are not responsible for its independent content, availability, privacy practices, or terms.

Your use of a third-party service may also be subject to that provider’s own terms and policies.

17. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, including:

• Expiration dates.

• Product restrictions.

• Minimum purchase requirements.

• Single-use limitations.

• Customer or region eligibility.

Unless otherwise stated:

• Discount codes cannot be exchanged for cash.

• Discounts cannot be applied after an order has been completed.

• Multiple codes cannot be combined.

• A promotion may be changed or withdrawn before an eligible order is placed.

We may reject promotional use that appears fraudulent, abusive, duplicated, or contrary to the stated promotion rules.

18. Intellectual Property

The Novellessa name, logos, website design, original text, graphics, promotional materials, and other store content are owned by or licensed to Novellessa and are protected by applicable intellectual-property laws.

You may view and use the website for personal shopping purposes.

You may not reproduce, distribute, modify, commercially exploit, or falsely claim ownership of our content without prior written permission.

Product names, trademarks, and materials belonging to suppliers or other third parties remain the property of their respective owners.

19. Reviews and Customer Content

If you submit a product review, photo, comment, testimonial, suggestion, or other content, you confirm that:

• You have the right to submit it.

• It is based on your genuine experience where represented as a review.

• It does not violate another person’s rights.

• It is not unlawful, abusive, deceptive, defamatory, or malicious.

You grant Novellessa permission to display, reproduce, format, and use submitted content in connection with the store and its marketing, unless otherwise prohibited by applicable law.

We may remove content that violates these Terms, appears fraudulent, contains personal information, or is unrelated to the product or service.

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and by service providers involved in payment, fulfillment, shipping, customer support, fraud prevention, analytics, or advertising where enabled.

21. Disclaimer of Warranties

We aim to provide accurate information and a reliable shopping experience.

However, to the maximum extent permitted by applicable law:

• The website is provided on an “as available” basis.

• We do not guarantee uninterrupted or error-free access.

• We do not guarantee that every website error will be corrected immediately.

• Delivery estimates are not guaranteed delivery dates.

• Product results may vary depending on use and circumstances.

Nothing in these Terms limits any product warranty, consumer right, or legal protection that cannot lawfully be excluded.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Novellessa will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website, delayed delivery, third-party services, or improper use of a product.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot lawfully be limited or excluded, or removes any mandatory consumer rights.

23. Proper Product Use

You are responsible for:

• Reading product instructions.

• Using products only for their intended purpose.

• Following charging, storage, cleaning, installation, and safety instructions.

• Keeping electrical products away from conditions not permitted by their instructions.

• Discontinuing use if a product appears damaged, overheats, emits an unusual smell, or operates abnormally.

Contact support@novellessa.com if you receive a product that appears defective.

24. Events Outside Our Control

We are not responsible for a delay or failure caused by events reasonably outside our control, including:

• Natural disasters.

• Severe weather.

• Carrier interruptions.

• Customs delays.

• Government action.

• Labor disputes.

• War, civil unrest, or transportation disruption.

• Power, network, or platform outages.

• Supplier or fulfillment interruption that could not reasonably have been prevented.

When possible, we will communicate material order delays and provide an appropriate resolution under our published policies.

25. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

26. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

27. Changes to These Terms

We may update these Terms to reflect changes to our store, services, policies, technology, or legal obligations.

28. Applicable Law

These Terms are governed by the laws that apply to the operation of Novellessa and to the customer’s transaction.

Nothing in these Terms removes any mandatory consumer rights or protections that apply in the customer’s place of residence.
